Well, let’s go back for just a minute and speak about each one. You’ve got a guy trying to buy the presidency, Bernie Sanders talking’ about Cuba, just give us your take.

Robert

Yeah, my view on this, Charlie, is that the Democratic party spent the last year working intensively, actually the last three, to impeach and remove a president, and they were caught flat footed here as they allowed candidates to line up who really weren’t qualified for this job. Bernie Sanders coming out and endorsing Castro is honest to God, it has curled people’s ears here in Washington, and it curled people’s ears in Florida, it has caused people to say what in God’s name is wrong with these people, and I think, all you need is a couple of bad apples, and what you have here is you have amateurs, Buttigieg, you have socialists, who are dangerous. Remember socialism, even orthodox socialism, is a first step toward communism. That’s the way Marx and Engels described it. It is not a halfway point or a destination. Then you’ve got people like Warren doing the same, Medicare for all, really veiled socialism, and then you’ve got the rich guys trying to buy their way in, Skyer and Bloomberg who really are Johnny come lately’s who really have no foundation under them you just, you look to see what are they standing on, they’re standing on really nothing. And then finally, you’ve got Biden, who honestly every single time I watch an interview of him, including after last night’s debate, I think to myself you know, he’s really got creeping senility, but he doesn’t want to admit it, and the Democrats don’t want to admit it because they’ve got no other options.

Charlie

Yeah, you saw the clip when he was running for Senator, right?

Robert

Yeah, I saw that, and then I, yeah. The guy is, honestly Charlie, there’s not a day, count them 30 in a month, 28 this month, there’s not a day that goes by that Joe Biden doesn’t make a mistake of some cognitive significance in discussing something with someone.

Charlie

I’m not the sharpest knife in the drawer, but when he said 129 million had been killed by gun violence, I’m goin’, holy cow, that’s almost half of our population.

A lotta people.

Robert

Yeah, and you know, I’m sure what he was trying’ to talk about was number of guns that are in the United States, or something like that, but the bottom line is, they have got the worst field that they have fielded, at least the 1960s and McGovern, but I really think even McGovern would look good on that stage. It tells you something.

Keith

Yeah it does.

Charlie

Bobby Charles, a senior member of AMAC, well but more than that, because now that we got our other guy, buddy Keith, we’ve got the mention only buddy, we found a guy from Louisville, okay. So we found a sidekick here. Bobby Charles, a great friend of KLFC radio in Branson, Missouri, former Assistant to Colin Powell, very active in the NASA program for years, and a good friend of Buzz Aldrin, always helps us out here. So, we’re looking’ at our, but we still have to keep our pedal to the medal because they hate Donald Trump so bad, Bob.

Robert

Yeah, that is right, and I think one of the great lessons of history is you don’t take your eye off the target. You don’t do it in combat, and you don’t do it in politics. There are some things that are creeping on the Democrats that are going to, in the next six to eight months really bother them dramatically, and by the way, Andy’s a great fellow that you also talk to, he’s really great on medical issues and spent time in the healthcare industry, but I just wanted, AMAC of course is always, always on items over the age of 50 and tries hard in this area to always make a difference for them, but in that vein, in that vein, there are creeping issues in the next six or eight months and people need to be aware of it, and one of the creeping issues is the Democrats are becoming aware that the 50 circuit judges that President Trump put on the bench, and the 28% of the entire federal bench that he has been able to fill, and the two on the Supreme Court, are now fundamentally changing the way in which review is done, so they’re returning it to a more constrained judiciary, a strict construction, just what’s in the Constitution, don’t invent things, don’t legislate things, don’t put things there that don’t belong there, and that’s why Sotomayor, last week, issued just a stunning dissent in which she attacked her fellow members on the court, personally, saying that they were animated by political bias which if you look underneath that decision, look a little closer, and what you see is that the circuit court in that case, that circuit is going to flip, and they’ve already flipped three circuits, they’re working’ on the 9th circuit, and she’s aware that the stay that was placed on the Trump action, which the court then reversed, if you follow me, what they did is the circuit court told the President he couldn’t do something on the regulations side.

Charlie

Right, hey, Bobby, I got to interrupt you for just a minute, this is too eerie. Are you reading my notes? Because this is exactly where we were headed after we talked about the debate, and so I’d like for us to focus on this so we can get our people up to speed for just a minute. Keith, remember when we were talking about Sotomayor and what she said. Go ahead.

Keith

And that comes from a case having’ to do with illegal aliens, or aliens, or something that. Tell us the case quickly.

Robert

Yeah, so Walt V. Cook County, the gist of this is that, it’s just so amazing. President Trump has the power to do regulatory, take a statute and put the implementing regulations with it to make it work. There’s a statute that they put under review, an immigration related statute, I think the count, non-cash benefits, as well as cash, that is given by the United States government or a state government to illegal aliens, or non-citizens, and when we’re trying to assess whether or not they will become a quote charge of the state. If they become a charge of the state, they are inadmissible as, they’re not allowed to stay in the country, so it would seem ultimately fair to say that most cash and non -cash benefits would be included. It’s a non-controversial definitional issue, and it’s way down in the weeds. Well, they tried to stop it, the circuit judge stopped it, said no you can’t do that because why, obviously he didn’t say so, but because you’re going to remove more of the illegal aliens if they’re also dependent on the state for non-cash benefits, and so the Supreme Court, 5-4, said no, no, no, no, no, no.

The President is well within his rights to do that. Sotomayor then issued a one person dissent, a scathing dissent, in which she says effectively that this court has been bought and sold by the President, and basically that judicial activism, which she’s saying behind the scenes is that judicial activism is under fire, we all have to scream from the rooftops, and so I’m going to scream about this case, and I’m going to say that my colleagues were politically biased. Now, this is wrong seven ways from Sunday. First of all, it’s wrong on the merits, because this, what the President did is well within his Constitutional rights. Secondly, it undermines the legitimacy of the Supreme Court at large, including her legitimacy, if you start a food fight at the Supreme Court, making attacks ad homonym, against one another, you’re truly undermining justice in America.

Charlie

You know, sometimes, our listeners will make comments to us, either through your texts or, maybe they call the phone or whatever, and you’ve had one?

Well, it’s always good to hear something like that, and I will tell you that what I do with the bulk of my time, beyond writing and talking with you, which I love doing, it’s a highlight, is I work with AMAC, and AMAC is this group of Americans that are in every state, you just look them up, AMAC.us, they have delegates in every single state, and they are essentially the conservative voice that is sort of the opposite number from AARP. They are the voice that comes to Washington and speaks all over the country on these exact issues, constitutional issues, issues tied to solvency of the United States government, and I’ll actually go a step further, a lot of the members are veterans, a lot of them are older veterans, they stand up for what is I’ll call it right, as patriotic and as believing in the importance of history in informing the present. What Sotomayor just as quickly jumped to that.

Charlie

Hey Bobby, I want you to hang on a minute because I’ve got a clip for you, okay. Listen very closely to Ted Cruz. He’ll explain to you explicitly about the stays, and then Bobby will follow up. Listen to this. As soon as I get it going’.

 Of course, it’s freezing on me, you knew it.

Of course.

Keith

You knew it would do that.

Robert

I can always do a Ted Cruz impersonation. I think well of the Senator.

Charlie

So, tell us about the, I want to get to the point, please, to where he talked about, in all the time with Obama, Bush, five, five requests for stays, okay. And for the Trump administration, are you ready, Keith?

Keith

Yep.

Charlie

Wow.

Charlie

50. Take us from there, Bobby.

Robert

Yeah, you know, I love American history because it informs us and it informs this exact situation, the one that Ted Cruz is talking about. What he’s describing is that there’s sort of a revolt in the ranks of the Judicial Branch at the federal level, it probably really starts with the district court judges, and you go back to the 9th circuit, you know, the President was trying to protect the Southern border, he was trying to say that countries, by the way, using the exact same countries Obama had used before, the countries that had a risk of potential terrorists coming into the country that we needed to vet their populations, whether they were of any religion, it happened they were majority, in many of those cases, majority Muslim, but the reality is, we had to vet to make sure that we didn’t have terrorists coming’ into the country. All of those District court decisions, what happened is, the District Judge, in a given part of the United States, would come to a ruling that was anti-Trump, and then they would try to apply that ruling nationwide. They’d say well, it applies everywhere. And of course, that’s a complete overreach. That’s not the way it historically has ever worked. And then, the circuit courts would try to essentially affirm that. A supreme court can only take so many cases, and so, there are an awful lot of these cases that have slipped forward.

What Cruz is really saying, and I think what the average American needs to know, is that this federal judiciary, which is supposed to, according to Roberts, not be Obama judges and not be Trump judges, and not be Bush judges, and there’s even some Reagan judges left in there, no, it’s all supposed to be, you know, robed and no political bias, well, they have really come down hard on this President, and this president in turn has used the process of the United States Senate confirmation appointments and confirmation to put 50 US Circuit Court judges on various circuit courts, in fact, he has already flipped three of them, including the second, which is very liberal. He is close to flipping the 9th, and that’s because gaps, with as people retire or die, gaps are filled by the current presidential appointments. This is terrifying the judicial activists who are on the federal bench, because what they’re seeing is that the last 30 years have been theirs. They’ve dominated it by changing the ethos of the judiciary. Instead of interpreting laws, they’ve been able to legislate, and create, and invent, and discover whatever they wanted. And he’s now appointing judges that say, no, no, no.

 We’re going to be faithful to the Constitution. If it’s not in the Constitution, then it’s not in our purview to make the ruling in that direction. It’s called textualism, it’s called original intent, it’s called being grateful to the founders, it’s not really controversial because the vast majority of the United States history has been characterized by a judiciary which had limited or restrained intervention in what the other two branches did, but what Ted Cruz is pointing out, quite rightly, is that this judiciary is rising now under a re-configuration by this president to make it conservative, and I’ll tell you, he’s only just begun, and I need to come back and tie this to AMAC, because remember, AMAC is not just judicially, politically conservative, but it’s also judicially conservative, which means that they’re interested in fidelity to the Constitution. It is that kind of an American that would feel the same way that your, that your interviewee felt, which is that you feel comfortable presenting in front of a Reagan, or a Bush, or a Trump appointee, and you feel uneasy because they’ve got their own agenda, very often appearing for a liberal judge. Now I will tell you. I clerked for a Reagan appointee on the U.S. Court of Appeals for the 9th Circuit. Talk about a lonely existence. There were three or four Reagan appointees at that time, and we ruled invariably, pursuant to whatever the constitutional construct was.

We were not going to invent law, but I can understand why anybody, and I’m a former litigator, and why anybody presenting at the appellate level, or at the district court level right now would be saying to themselves, I’ve got to calculate into what I say, the political leaning of the judge, and that’s because this bench has become activists over the last 30 or 40 years. It’s no longer the sort of, the majestic simple interpreter based on non-political factors of the law. And that’s what Trump’s putting in. He’s not putting in political conservatives, he’s putting in judicial conservatives who are faithful to the reading of the text of the Constitution.

Keith

You know, a few weeks ago, or maybe a couple months ago, we heard about this virus starting in China, and everybody just kind of said well, it’s over there, and it’s not over here, and bla bla bla. But now we’re sitting on the threshold of, I mean, you talk about trying to invoke fear, more than just preparedness. Preparedness, I’m all for that, and we need to be aware of what’s going on around us, but they’re almost getting to the point where they’re saying, all right, batten down the hatches because it’s coming. What do you think?

Charlie

Well, what I also think, and I want Bobby to comment on, is the Democratic Congressman or Senator that came out from a closed door, what did I say, not confidential but, what’s the word there?

Keith

It was a classified briefing.

Charlie

Classified information, and he walks to the microphone after the classified briefing and he said the American people need to know exactly what they told us in there, again giving us a edge of fear. I don’t know much about coronavirus, except I want to wash my hands, keep an eye on it, help us, Bobby.

Robert

Yeah, I want to calm your listening audience down, and again, recognize that I work with a group of people who, and I believe very firmly in the AMAC who are over the age of 50, by definition, and again, I wrote about this on the AMAC website, amac.us, you know, you don’t have to be a member to read the website. You can become a member, easily, once you have. It’s very cost effective. But the reality here, which I wrote, and I keep track of this every day. I ran programs in 70 countries for Colin Powell, and we had all kinds of problems, health and safety problems in all those countries. We did, there has been a period in the last 20 years where people should’ve been very curious and very concerned and those relate to the SARS cases and to the MRS cases. SARS came out of China, MRS came out of the Middle East. But the coronavirus, I’m not telling people, if and when more of it arrives here, not to wash their hands, not to be prepared, but I’m going to tell you that a pandemic, you’re going to hear lots of people say oh my god, it’s a pandemic. So, a pandemic is simply any virus, or anything, that relates to health that spreads to a certain number of countries and becomes global in reach. That does not mean it’s going to kill everybody that’s infected, and I’m going to go one step further.

In my, and I’m not a doctor, but I am an avid and voracious reader of the literature that’s coming out of China and around the world. This is a virus, like many unknown viruses that are out there in the world that has the basic effects of a severe cold. Even the CDC describes symptoms as mild. So in reality, just like the flu kills people who are of compromised immune systems, or are sufficiently old that their immune systems are not working properly, or are extremely young and so they don’t have a library, if you will, of responses to viruses, by and large, that’s the only group that appears to be vulnerable here. And so if the entire planet got this coronavirus, Covid 19, you’d have a lot of people sneezing and coughing for a little while, and at the end of the day, you’d have a percentage, probably in the nature of 2%, that would have died from the effects. But the vast majority of Americans, Indians, Chinese, Filipinos, whoever, they’ve now shut down airports in Italy, some portion of Italy, most of these people could get this and be just fine after a few weeks, now, you just do need to understand, that doesn’t mean it’s a good thing. It doesn’t mean you shouldn’t be cautious. It doesn’t mean that if the CDC puts out warnings you shouldn’t follow them, but I think that, you know, Colin Powell used to always remind us, you don’t have to get spun up about everything. And I think this is a situation where, being of reason, you know, allowing reason and a level head to govern how both the country responds and how you individually respond is the smart thing to do.

The president is doing everything that needs to be done. He’s rightly being cautious and thoughtful and directed and focused, and I ensure that they will check at every airport and port of entry, but you know, this is not the black plague. It may be an economic black swan event, but it is not the black plague. My feeling is, we just have to keep this in perspective, the coronavirus is a virus. It’s very similar, I think, I’m not a scientist, I’m only reading CDC material, but you know, it’s something that’s creating mild effects even though it’s affecting a larger number of people.

Would you be so kind as to send this to the Congressman that came out and acted like the sky is falling? Hey, this gives me another reason to say, man I wish I’d had the opportunity to meet Dan Weber, the founder of the Association of American Citizens, he would’ve loved this dialogue and what we’re doing’. Hey, let me tell you how God works on this program, Bobby. We’re pretty, not that we’re booked all the time, Josh Harley’s been trying to get with us for almost a week and a half, but since he was honored by the President after the post-impeachment speech, he’s just been so busy and so we had an open date on Wednesday, and so the other day, when I was talking’ to our production staff, they said Wednesday was open, and I said don’t worry about it, I’ll handle it. Well, Keith, you know what that means. That means I’m looking for everybody from the, I’m just thinking’, and look at this. We have the debate last night, we have Bobby today, how could that be any better just for him.

Honestly, you two are doing extraordinary things for America and for all your listeners, and I, I don’t say that because we’re on air, I say that to you off air, it’s a fact that there’s an awful lot of disinformation and misinformation out there and sometimes you just have to sit back and touch the granite, and recognize that there are some hard truths, whether it’s not getting spun up about something just because the media tells you you need to, or it’s believing that the first amendment and the right to the free exercise of our religion is something that we actually ought to be permitted and are permitted to exercise under the Constitution so, it’s always my honor to be with you, and feel free to call anytime, again, you’ve got a great show, and I’m always privileged to be on it.
